By purchasing services through this website, I agree to have Fitucate Nutrition & Training  design a meal program, training program to enhance my health and fitness goals. I will follow that program to the best of my ability and I will not hold Fitucate Nutrition & Training, or any known affiliates or parties personally liable for any problems, illnesses or injuries that might occur due to a sudden change in my eating habits or training. I understand that Fitucate's staff are not  registered or licensed dietitians, nor a medical practitioner. This program does not replace the expert advice or medical treatment of my own private doctor. I have given Fitucate Nutrition & Training all necessary information about myself to prevent any possible complications. I understand all sessions require 48 hour cancelation notice or are subject to loss. All services are non transferable & must be used by the intended client. All sessions must be used in the designated time allotment or will be lost. Fitucate Nutrition & Training is not responsible for lost sessions and is able to terminate a client at any time without notice. I also understand I am financially responsible for all services rendered and must pay invoices in full prior to first session.

MEMBER’S RESPONSIBILITY. All use of the instruction, classes and equipment shall be undertaken at my sole risk, and Fitucate Nutrition & Training LLC, and/or its affiliates/staff shall not be liable for any harm, injuries, death or damage to me or my property, or be subject to any claim, demand, liability or damages whatsoever, including, without limitation, those resulting from acts of active or passive negligence on the part of Fitucate Nutrition & Training LLC and/or its affiliates, it’s successors or assigns, as well as its officers and agents, for all such claims, demands, liabilities, damages, actions or causes of actions. It is specifically agreed that Fitucate Nutrition & Training LLC and/or its affiliates shall not be responsible or liable for articles lost, damaged or stolen in, about or in connection with the facility nor for loss or damage to any other of my property, including automobiles and contents. It is also agreed that any damages to Fitucate Nutrition & Training LLC and/or its affiliates, or the facility and its contents, or property or the property of any member by another member is the sole responsibility of the offending member.
